OUR COMMITMENT TO OUR USERS
We don’t ask you for your personal information unless it is absolutely necessary for you to contact us to hear about our services, join our newsletter, download or sign up to receive content, offer our services, or join our team. We take a “Minimum Viable Data” approach to all data collection practices and ensure we are never collecting additional information beyond the necessary scope of service.
We limit sharing your personal information where possible, but will occasionally share it with trusted partners for the purposes of co-marketing and co-sponsoring events, and to comply with applicable laws, develop, enhance or modify our services or protect our rights.
We don’t store personal information on our servers unless required for the on-going operation of one of our Services on behalf of our Clients or as specified on our website forms.
Measure Up Podcast (“Measure Up Podcast,” “we,” “us,” or “our”) operates www.measureup.show , the subdomains, and all portals, products, services, events, and interactive features, or other services controlled by us that post a link to this Privacy Notice (the “Site”). It is Measure Up Podcast’s policy to respect your privacy regarding any information we may collect while operating the Site. This Privacy Notice governs information that we collect from you on the Site. We refer to all of the above as “Services.” This Privacy Notice only applies to Personal Information and other information collected by us from: (i) visitors to the Site (“Site Visitors”); (ii) our current and prospective customers and Clients (“Clients”); and (iii) people applying for employment with Measure Up Podcast (“Employment Applicants”).
Measure Up Podcast is a data controller for data collected on the Site and in most cases is a data processor for our Clients.
1. PERSONAL INFORMATION COLLECTED
1.1. Personal Information You Provide Directly To Us
As you interact with the Site or Services, Measure Up Podcast may ask you to provide us with certain personal information that can be used to contact or identify you (“Personal Information”) via webforms or inputs/uploads on the Site, and through webinars, events, telephone calls, letters, emails, texts and other communications with you. Personal Information includes, but is not limited to the following:

Clients

- Financial information such as your business credit card or debit card number, bank account information and your payment, service and purchase history.
Employment Applicants
- Contact information such as your first and last name, email address, home or business address, shipping address, telephone numbers, mobile numbers;
- Your current or past employment or educational information;
- Relevant licenses and certifications; and/or
- Other information that could reasonably be used to identify you personally.
Your decision to provide us with Personal Information is voluntary, but if you choose not to provide any requested Personal Information, you may not be able to take advantage of all the features of the Site or Services.
1.2. Information Automatically Collected from the Site
Like most website operators, Measure Up Podcast collects non-personally identifying information of the sort that web browsers and servers typically make available, such as the browser type, language preference, referring site, and the date and time of each Site Visitor request. Measure Up Podcast’s purpose in collecting this non-personally identifying information is to better understand how Visitors use the Site.
Measure Up Podcast may also collect potentially personally identifying information like Internet Protocol (IP) addresses. Measure Up Podcast only discloses IP addresses under the same circumstances that it discloses personally identifying information as described below.
For location information, some of our Services may include features based on an individual’s actual location and may report on an individual’s current location (“Location-Based Services”). To the extent you use any Location-Based Services, we may collect and store information about your location at the time you use those Location-Based Services (in addition to some automatically collected geolocation data). This information can come from a variety of sources depending on the device you use to access the Services; for example, a mobile phone may report its GPS location at the time Location-Based Services are used.

Please note that if you disable such features, your ability to access certain features, Services, content, or promotions may be limited or disabled.
1.3. Information Received Directly from Clients
Measure Up Podcast may receive data, including personally identifiable or aggregate data, from our Clients that we process per a contract in place with these Clients. We do not have a direct relationship with these individuals and are acting as a service provider to our Clients in this instance. While we maintain this data, we are only permitted to use it at the direction of the Client to provide the Services we are contracted to provide.
1.4. Cookies
A cookie is a string of information that a website stores on a visitor’s computer, and that the visitor’s browser provides to the website each time the visitor returns. Measure Up Podcast uses cookies to help us identify and track Site Visitors, their usage of the Site, and their website access preferences. Site visitors who do not wish to have cookies placed on their computers should set their browsers to refuse cookies before using the Site, with the drawback that certain features of the Site may not function properly without the aid of cookies.
1.4.1. What Kinds of Cookies and Tracking Technologies Do We Use?

- Performance Cookies: We use these cookies to count visits and traffic sources, to measure and improve Site performance. They help us to know which pages are the most and least popular and see how Site Visitors move around the Site. Performance Cookies do not store any Personal Information. Specifically, for analytics providers, we use Google Analytics. Google Analytics, which is a web analytics service offered by Google tracks and reports website traffic. Google Analytics shares this data with other Google services. Google may use the collected data to contextualize and personalize the ads of its own advertising network. Withdrawing your consent will not affect the lawfulness of any processing we conducted prior to your withdrawal, nor will it affect processing of your Personal Information conducted in reliance on lawful processing grounds other than consent.
- Functional cookies: These cookies allow the Site to remember choices you make and provide enhanced functionality and more personalized features. Depending on context, Functional Cookies may store certain types of Personal Information as needed to provide functionality.
- Targeting Cookies: Targeting cookies help us manage and display our advertisements, based on your activity on the Site and other websites; this is known as interest-based advertising. Targeting cookies mainly rely on uniquely identifying your browser and internet device. To better serve users’ preferences, we have partnered with the Digital Advertising Alliance (http://youradchoices.com); by visiting their website, you can learn more about their members who deliver tailored online ads and your choices to opt-out of receiving them. We may also use third-party service providers to show advertisements, which may include targeted advertisements on a third-party website after you have visited the Site. We and the third-party service providers use cookies to inform, optimize, measure performance and serve ads based on your previous visits to the Site. Any tracking that a third-party performs is subject to their own privacy notice. Our third-party service providers may provide us information that tells us how our marketing ads, often placed on third-party websites, performed and who clicked on them. This information does not identify any specific individual and is generally non-identifying. If we were to associate it with you, we would treat it as Personal Information.
- Social Media Cookies: Social Media Cookies make social sharing easier for you, provide you with tools to connect with the Site, and help us better understand both the audience for the Site and the effectiveness of our social media outreach. These are third-party cookies. Your choices with respect to such cookies are determined by the social media platforms on which you have accounts. Social media cookies store Personal Information as needed to provide functionality.

There are online tools available for clearing all cookies left behind by the websites you have visited, such as www.allaboutcookies.org. Usually, deletion of cookies will anonymize the information associated with the pixel and a website will not receive any further associated information.
Please note at this time, we do not recognize automated browser signals regarding tracking mechanisms, which may include “do not track” instructions.
1.5. Aggregated Statistics
Measure Up Podcast collects statistics about the behavior of visitors to the Site. For instance, Measure Up Podcast monitors the most popular blog posts or pages on the Site. Measure Up Podcast may display this information publicly or provide it to others. However, Measure Up Podcast does not disclose personally identifying information other than as described below.
2. USE OF YOUR PERSONAL INFORMATION
As mentioned, the Personal Information that Measure Up Podcast collects and stores relating to you is used to communicate to you and to provide our Services to you. 2.8. Log Data

- To troubleshoot Service functionality and fix bugs;

If you are a Site Visitor, Measure Up Podcast will only contact you when you have provided consent and only by those means you provided consent.
3. HOW WE SHARE AND DISCLOSE YOUR PERSONAL INFORMATION
Measure Up Podcast does not share your Personal Information with others except as indicated within this policy or when we inform you and give you an opportunity to opt out of having your Personal Information shared.
3.1 Third Party Service Providers, Employees, Agents or Contractors
Except as otherwise described in this Privacy Notice, Measure Up Podcast discloses potentially personally-identifying and personally-identifying information only to those of our employees, contractors and affiliated organizations that (i) need to know that information in order to process it on Measure Up Podcast’s behalf or to provide services available through the Site, and (ii) that have agreed not to disclose it to others. Some of those employees, contractors and affiliated organizations may be located outside of your home country; by using the Site, you consent to the transfer of such Personal Information to them. You may opt out of us providing such Personal Information by opting out of our email newsletter and/or not registering for joint marketing events. However, anonymized visitor information may be provided to other parties for marketing, advertising, or other uses.
3.3 To Comply With Legal Process Or To Protect Measure Up Podcast
Other than to its employees, contractors and affiliated organizations, as described above, Measure Up Podcast discloses potentially personally-identifying and personally-identifying information in response to a subpoena, court order or other governmental request, or when Measure Up Podcast believes in good faith that disclosure is reasonably necessary to protect the property or rights of Measure Up Podcast, third parties or the public at large.

Measure Up Podcast service providers use appropriate safeguards to transfer your personal data to the United States.
- Measure Up Podcast may transfer the Personal Information that we collect from you to locations outside of headquarters for processing and storing. In addition, it may be processed by staff operating outside the office area who work for us or for one of our suppliers. For example, such staff may be engaged in the processing and concluding of your order, the processing of your payment details and the provision of support services. By submitting your Personal Information, you agree to this transfer, storing or processing. Measure Up Podcast will take all reasonable steps to make sure that your Personal Information is treated securely and in agreement with this Privacy Notice.
- Personal Information that is provided to Measure Up Podcast is stored in our cloud. Details relating to any transactions entered into via the Site will be encrypted to ensure its safety.
- The transmission of information via the internet is not completely secure and therefore Measure Up Podcast cannot guarantee the security of data sent to Measure Up Podcast electronically and the transmission of such data is entirely at your own risk. 6. CHOICES AND INDIVIDUAL RIGHTS
Measure Up Podcast aims to take reasonable steps for you to correct, amend, delete or limit the use of your Personal Information. If you are a customer of one of our Clients that works with Measure Up Podcast and would no longer like to be contacted by them, please send your request to the Client that you interact with directly. If our Client requests Measure Up Podcast to remove or amend your Personal Information, we will respond to that request within thirty (30) days. Measure Up Podcast outlines your choices below:
6.1. Email
As described above, if you do not wish to receive promotional emails from Measure Up Podcast or for us to share your Personal Information with a joint partner in co-branded marketing events, you may opt out at any time. If you opt out of a promotional email, Measure Up Podcast may still send you transactional and administrative emails about this privacy notice or about the Services for which you have contracted with us.

7. YOUR RIGHTS UNDER THE GENERAL DATA PROTECTION REGULATION (“GDPR”)
This section of the Privacy Notice applies solely to Visitors, users, and others who reside or are located in the European Economic Area (“EEA”). We adopted this section to comply with European privacy laws, including the GDPR. Any terms defined in the GDPR have the same meaning when used in this Section. In most instances, Measure Up Podcast is the data processor for processing Personal Information for our Clients.
We have listed below the rights that you may be able to exercise in respect of the processing of your Personal Information, subject to applicable law. We take every reasonable step to ensure that the Personal Information that we process are limited to the Personal Information that are reasonably required in connection with the purposes set out in this Privacy Notice.
If you are a resident of or located within the EEA, you have certain data protection rights. These rights include:
- The right to access, update or delete the Personal Information we have on you. Whenever made possible, you can access, update or request deletion of your Personal Information by contacting us at the contact information below.
- The right of rectification. You have the right to have your Personal Information rectified if that Personal Information is inaccurate or incomplete.
- The right to object to processing. You have the right to object to our processing of your Personal Information.
- The right of restriction. You have the right to request that we restrict the processing of your Personal Information.
- The right of deletion. You have the right to request that we delete or remove Personal Information when there is no good reason for us to continue processing it.
The right to data portability. You have the right to be provided with a copy of the Personal Information we have on you in a structured, machine-readable, and commonly used format. - The right to withdraw consent. You also have the right to withdraw your consent at any time where Measure Up Podcast relies on your consent to process your Personal Information.
7.1. Legal Basis for Processing Personal Information
Measure Up Podcast relies on the following lawful grounds to collect and process any personal data you may have provided:
- Legitimate Business Interests: Our use of Personal Information relating to your use of the Site and/or the Services, described above, is necessary for our legitimate interests in understanding how the Site and the Services are being used by you, to improve your experience with them, and to contact you with information about our Site and Services. We also have a legitimate interest in aggregating and/or anonymizing the information that we collect through the Site and/or the Services and using this information for our business purposes, as described above. - Performance of Contract: Processing of your Personal Information that you provide to us when you interact with our Services is necessary to respond to or implement your request prior to entering into a contract with us. We use account-related data to provide you with access to the Services, contact you regarding your use of the Services or to notify you of important changes to the Services. Such use is also necessary for the performance of the contract between you and us.
- User Consent: If you are a Site Visitor and have supplied your email address and provided consent, Measure Up Podcast may occasionally send you emails to tell you about industry news and information, solicit your feedback, or keep you up to date with what’s going on with Measure Up Podcast and our services. We primarily use our email newsletter or email you updates on our blog to communicate this type of information. If you do not provide us with your consent to the processing of your Personal Information for this purpose, we will not send you this information. You have the right to withdraw your consent at any time as described below.
- Employment Application: When you apply for employment through the Site, processing of Personal Information such as your contact details and data about your employment history and education (as needed to evaluate your job application, to conduct job interviews, and as is otherwise needed for recruitment) is necessary to respond to your request to process your application for employment. If you do not provide this Personal Information, we will not be able to process the application that you send through the Site.
7.2. Retention of Personal Information
Measure Up Podcast will retain your Personal Information only for as long as is necessary for the purposes set out in this Privacy Notice. We will retain and use your Personal Information to the extent necessary to comply with our legal obligations (for example, if we are required to retain your Personal Information to comply with applicable laws), resolve disputes and enforce our legal agreements and policies.
All information you provide to us is stored in our cloud or those of our third-party data storage providers.
7.3. Exercising Your Rights Under GDPR
If applicable, you may exercise any of your rights under the GDPR by submitting a verifiable data subject request to us by using the contact details below. You may make a request related to your Personal Information or on behalf of someone for which you have authorization. You must include your full name, email address, and attest to the fact that you are a citizen or resident of the EEA by including your country of citizenship or residence in your request. We may require you to confirm your identity and/or legal standing for the request as well as your residency in the EEA in order to obtain the information. We will respond to your request within 30 days or let you know if we need additional time.
Please note that we will ask you to verify your identity before responding to such requests, and we may deny your request if we are unable to verify your identity or authority to make the request.
Should you wish to raise a concern about our use of your data (and without prejudice to any other rights you may have), you have the right to do so with your local supervisory authority.
7.4. Right to Lodge a Complaint
For European Union residents, if you feel that Measure Up Podcast’s processing of your personal data infringes on data protection laws, you have a legal right to lodge a complaint with a supervisory authority responsible for data protection. You may do so in the EU member state where you habitually reside, your place of work or the location of the alleged infringement. If you are located outside of the European Union, you may have rights under privacy laws in the jurisdiction where you live.

This section of our Privacy Notice applies to consumers who reside in California. We adopt this section to comply with the California Consumer Privacy Act of 2018 (“CCPA”).

- The specific pieces of Personal Information we have collected about you;

We will deliver Personal Information that we are required by law to disclose to you in the manner required by law within forty-five (45) days after receipt of a verifiable request, unless we notify you that we require additional time to respond, in which case we will respond within such additional period of time required by law. We may deliver the Personal Information to you through your account, if you maintain an account with us, or electronically or by mail at your option. If electronically, then we will deliver the Personal Information in a portable and, to the extent technically feasible, in a readily usable format that allows you to transmit the information from one entity to another without hindrance. If we receive a Right to Know request regarding Personal Information that we process on behalf of our Client, we will also recommend that the California resident submit a Right to Know request directly with the client, and will provide contact information for that client where feasible.
Right to Limit Use and Disclosure of Sensitive Personal Data
You have the right to request to limit the use or disclosure of certain sensitive personal information we collected about You unless an exception applies.
8.2. Right to Deletion of Personal Information
You have the right to request that we delete Personal Information about you that we have collected from you. If we are able to verify your identity or the identity of your authorized agent, we will respond to your request by deleting your Personal Information and, if applicable, directing any of our service providers to delete your Personal Information.
We may choose to delete Personal Information by de-identifying, aggregating, or completely erasing the information. We will specify the manner in which we delete your Personal Information. If a California resident submits a request to delete Personal Information to one of our Clients and the client instructs us to delete the California resident’s Personal Information, we will delete the information as required by the CCPA. If we receive a Right to Deletion request regarding information that we process on behalf of our client, we will also recommend that the California resident submit a Right to Deletion request directly with the Client and will provide contact information for that Client where feasible.
As permitted by the CCPA/CPRA, if you request deletion of Personal Information that we have collected about you, we, our service providers, and our contractors may be unable to comply with such a request if your Personal Information is necessary to:
- Complete the transaction for which the Personal Information was collected, provide a good or service requested by you, or reasonably anticipated within the context of our ongoing business relationship with you, or otherwise perform a contract between us and you;
- Prevent, detect, and investigate security incidents, protect against malicious deceptive, fraudulent, or illegal activity; or prosecute those responsible for that activity;
- Debug to identify and repair errors that impair existing intended functionality;
- Exercise free speech, ensure the right of another Consumer to exercise his or her right of free speech, or exercise another right provided for by law;

We will maintain records of requests made pursuant to the CCPA for a period of at least 24 months.

California Civil Code § 1798.83 further permits California residents to request certain information regarding our disclosure of Personal Information to third parties for their direct marketing purposes. 9. YOUR VIRGINIA PRIVACY RIGHTS
If you are a resident of Virginia, you have the right under the Virginia Consumer Data Protection Act, upon a verified request, to:

- To delete your personal data;
- To obtain a copy of your personal data that you previously provided to us in a portable, and if technically feasible, readily usable format, if processing is carried out by automated means;

To exercise these rights, you may make a request to confirm, access, correct, delete, obtain a copy, or opt-out of the processing of your Personal Information for targeting advertising, sale, or profiling by contacting us using the information in the Contact Us section below:
We may require you to confirm your identity and your residency in order to obtain the Personal Information, and you are only entitled to make this request up to twice annually. For emails, please include “Virginia Privacy Rights” as the subject line. You must include your full name, email address, and attest to the fact that you are a Virginia resident. We will process your request within forty-five (45) days or let you know if we need additional time or cannot process your request. If you make this request by telephone, we may also ask you to provide the request in writing so that we may verify your identity. If we are unable to honor your request for any reason, we will notify you of the reason within the request time period.
If we decline to take action on your request, residents of Virginia can appeal our decision by submitting our Contact Us Form and noting “Virginia Privacy Rights Appeal” and we will review your request and respond with a written explanation of the reasons for our decision. If your appeal is denied, you may contact the Virginia Attorney General to submit a complaint.
10. SECURITY
Measure Up Podcast cares about the security of your Personal Information. Although we cannot guarantee 100% security, we use reasonably appropriate security measures to protect your Personal Information against unauthorized use, access, modification, destruction or disclosure. We require our third-party service providers to use similar safeguards to those we use.
11. SENSITIVE DATA
Measure Up Podcast requests that you do not send us any sensitive data such as social security or national identification numbers, information related to racial or ethnic origin, political opinions, religious beliefs, health data, biometrics or genetic, criminal background or trade union membership information. If you do send Measure Up Podcast this information, then you are consenting to its processing in accordance with this privacy notice. To avoid processing of sensitive data, do not submit it.
12. OUR POLICY ON CHILDREN’S INFORMATION
The Site is not directed to children under 16. If we learn that we have received Personal Information from a child who is under 16, we will delete the data. If you learn that your minor child has provided Measure Up Podcast with Personal Information without your consent, please contact us via the Contact Form.
13. PRIVACY NOTICE CHANGES
Although most changes are likely to be minor, Measure Up Podcast may change its Privacy Notice from time to time, and in Measure Up Podcast’s sole discretion.
